i don't know if you caught this or not, but she is. the reason she is getting out early is because continued her education while in jail.

at least we have someone getting out of jail that has the capability to contribute to society. not someone eating my tax dollars living off of government programs.

I hate to be such a dick about this but:

vehicular manslaughter
n. the crime of causing the death of a human being due to illegal driving of an automobile, including gross negligence, drunk driving, reckless driving or speeding. Vehicular manslaughter can be charged as a misdemeanor (minor crime with a maximum punishment of a year in county jail or only a fine) or a felony (punishable by a term in state prison) depending on the circumstances. Gross negligence or driving a few miles over the speed limit might be charged as a misdemeanor, but drunk driving resulting in a fatality is most likely treated as a felony. Death of a passenger, including a loved one or friend, can be vehicular manslaughter if due to illegal driving.

It's really up to the judge to decide whether or not this is the crime commited. But since there would be no malice aforethought and a DUI death would lack any pirior intention of the death of an individual there is a small chance of a judge stating that this is murder.

edit: Sorry if I have offended anyone, I know that DUIs are very touchy around here.

I guess I don't feel that 5 months is enough time for her to learn her lesson.

I hope I'm wrong.

Well, theyd better put a breathlyzer test thing in her car to be able to start it. They do actually do that dont they?

everyone deserves a second chance unless theyre criminally insane, but after that who really cares if you arent going to learn your lesson.

If the victim's family agreed that 15 months was good enough for them, then (even if I don't agree) it is good enough for me.

No I am not someone who thinks all DUI cases should be punishable by death.

Update: 2020

She lives in Boulder, CO. She has been drinking and driving here for years. You’d never guess she killed someone. Boulder county police cited her for a dui in 2018.
